Website Rental - TERMS AND CONDITIONS OF TRADE & PRIVACY POLICY

By using our website rental services, you agree to these Terms of Service and Privacy Policy. Please read them carefully.

1. Definitions & Interpretation

1.1 “Supplier,” “we,” or “us” refers to Website Rental, including our successors and assigns.
1.2 “Client,” “you,” or “your” refers to the person or business purchasing website services from us.
1.3 “Services” refers to all services provided by Website Rental, including website design, development, UX/UI, basic content writing, minimal SEO, eCommerce setup, and hosting management support.
1.4 “Agreement” means these Terms & Conditions, our Privacy Policy, and any associated schedules or amendments.
1.5 “Website” refers to the custom website we build for you, hosted on the Squarespace platform.
1.6 “Business Plan” and “Mini eCommerce Plan” refer to our Rent-to-Own plans, where ownership transfers after 24 consecutive monthly payments.
1.7 “Rent-to-Own Model” refers to a 24-month interest-free payment arrangement where ownership of the website design and content is transferred to the client after full term completion.
1.8 “Cancellation” refers to any decision by you to end the rental agreement before completing the 24-month term.

2. Scope of Services

2.1 We design, build, and manage websites using Squarespace. Each website includes responsive design, basic SEO setup, and initial content population.
2.2 You are responsible for providing brand-specific materials such as logos, high-quality images, and videos.
2.3 All websites are fully functional and live once approved by you.
2.4 Under the Business ($99/month) and Mini eCommerce ($199/month) Rent-to-Own plans, ownership of your website design, layout, and content transfers to you after 24 months of uninterrupted payments.
2.5 After ownership transfer, you will receive up to 10 hours of handover support or training to help you manage your site independently.
2.6 Before ownership transfer, all designs, code, and content remain the sole property of Website Rental NZ.

3. No Transfer of Website Before Ownership

3.1 Until full ownership is granted under the Rent-to-Own model, all website designs, content, and source code remain the exclusive property of Website Rental.
3.2 If you cancel your plan before completing 24 months, you will lose all rights to the website, including its design, structure, and content.
3.3 You may not copy, duplicate, transfer, or reuse the website design, content, or code elsewhere unless ownership has officially transferred.
3.4 Cancellation at any point resets the Rent-to-Own term if you rejoin later.
3.5 Ownership transfer applies only to Business and Mini eCommerce plans — all other plans remain rental-only.

4. Rent-to-Own Model

4.1 You pay monthly ($99 or $199 NZD) for 24 months. After this period, ownership of your website design, layout, content and any custom codes transfers to you.
4.2 After ownership transfer, you only pay Squarespace hosting directly — approximately $36 USD/month (Business) or $40 USD/month (Mini eCommerce), or less if billed annually.
4.3 After transfer, our involvement and support agreement end unless you opt into a new maintenance plan.
4.4 If you cancel before the 24-month term ends, you do not own the website — it remains property of Website Rental.
4.5 The Rent-to-Own arrangement is 100% interest-free and can be cancelled anytime with no penalties.

5. Pricing & Payment

5.1 All our prices are in New Zealand Dollars (NZD) and are billed monthly or annually in advance.
5.2 Payments are non-refundable once billed.
5.3 You can cancel anytime with 7 days’ written notice before your next billing cycle.
5.4 Cancelling early forfeits any Rent-to-Own progress.
5.5 Fees charged by Squarespace or other third parties are separate and not included in your Website Rental payment.
5.6 Stripe payment fees (usually 2.9% + 30¢ per transaction) are not controlled by us and may change at any time.
5.7 If a free domain was included, early cancellation (within the first 12 months) incurs a $50 NZD domain registration fee.

6. Limitation of Liability

6.1 We are not liable for any business loss, profit reduction, or interruption caused by third-party services, downtime, or platform updates.
6.2 Our total liability will not exceed the amount paid to us by you.
6.3 We do not guarantee specific business results, revenue, or search ranking improvements.
6.4 We are not responsible for any losses caused by changes in third-party platform pricing (e.g. Squarespace or Stripe).
6.5 You are solely responsible for the accuracy, legality, and compliance of your website content.

7. Website Usage & Restrictions

7.1 The website is provided solely for your business use under this agreement.
7.2 You may not copy, resell, or reproduce the design or content on other platforms before ownership transfer.
7.3 After ownership transfer, you assume full responsibility for compliance with New Zealand’s Privacy Act 2020, Fair Trading Act, and Consumer Guarantees Act.

• Deliver and manage website rental services

• Process payments and invoices

• Communicate updates or offers (you can opt out anytime)

4. Sharing Information

We do not sell or rent your data.
We may share limited data with trusted third parties (Squarespace, Stripe) to fulfil your service — all of whom are bound by confidentiality agreements.

5. Cookies

We use cookies to improve your browsing experience. You can disable them in your browser, though some site features may not work properly.

6. Security

All payment information is processed securely through encrypted SSL connections. We never store credit card details.

7. Your Rights

You may access or correct your personal data at any time under the Privacy Act 2020 by emailing us at support@websiterental.co.nz.

8. Retention

We retain data only as long as necessary to deliver our services or comply with legal requirements.

9. Updates

We may update this Privacy Policy periodically. Updates will be published on this page, and major changes will be communicated by email.
